This is a legal document which constitutes an agreement between you, the end-user, and Screenplay Systems, Inc.
Carefully read all the terms and conditions of this agreement prior to pressing the AGREE Button. Pressing the AGREE Button indicates your acceptance of these terms and conditions. This constitutes the complete agreement between you and Screenplay Systems, Inc. If you do not agree to these terms and conditions, return the uninstalled program and the other components of this product to the place of purchase and your money will be refunded. No refund will be given for products that have missing components or installations, or components that are not in saleable condition.
LICENSE
You have the non-exclusive right to use the enclosed program. In the case of an evaluation copy it may have an expiration date at which point your license to use said evaluation product will end. This program can only be used on a single computer. You may load this program onto more than one computer provided that the program is used on only one computer at a time. If this distribution package contains multiple forms of media, you are licensed to use only one of the media forms at a time. You may not electronically transfer the program from one computer to another over a network. You may not make modifications of any kind, either to the program itself or the environment in which it operates, that suppress the program’s screen output. You may not distribute copies of the program or documentation to others. You may not modify, translate, disassemble or reverse engineer in any way the program or related documentation without prior written permission of Screenplay Systems, Inc.. In short, you may not use, copy, modify or transfer the program or documentation in any copy except as expressly provided in the agreement.
INSTALLATION, BACK UP AND TRANSFER
The enclosed installation media will allow only a limited number of installations before requiring a password for additional installations and/or may require web validation before functioning. Once installed into a computer, you may make one copy of the program from the files from that computer solely for backup purposes. You must reproduce and include the copyright notices on the backup copy. You may transfer your license to use the product to another party, if the other party agrees to the terms and conditions of this Agreement and completes and returns a registration form to Screenplay Systems, Inc.. If you transfer the program, you must at the same time transfer all original materials and destroy all copies of the software and documentation that remain in your possession.
COPYRIGHT
The program and related documentation are copyrighted. You may not copy the program or its documentation except for backup purposes and to load the program into the computer as part of executing the program. All other copies of the program, including software that has been modified, merged, or included with other software and its documentation are in violation of this agreement.
WARRANTY
The program is provided “as is” without warranty of any kind; the entire risk as to the results and performance of the program is assumed by you. Screenplay Systems, Inc. makes no representation or warranties with respect to the contents hereof and specifically disclaim any implied warranties of merchantability or fitness for any particular purpose. Further, Screenplay Systems, Inc. does not warrant, guarantee, or make any representations regarding the use of or the results of use of the program in terms of correctness, accuracy, reliability, or otherwise; and you rely on the program and its results solely at your own risk. Screenplay Systems, Inc. shall have no liability or responsibility to you or any other person or entity with respect to any loss or damage caused by this program including, but not limited to, any loss of profits, interruption of service, loss of business or consequential damages resulting from the use of such programs.
GENERAL
If any provision of this Agreement shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of the remaining provisions of this agreement.
